7. Orders and Acceptance
We reserve the right to accept, reject, limit, hold, or cancel any order, subject to applicable law.
An order confirmation acknowledges that we received your order. It does not necessarily constitute final acceptance of the order.
We may cancel or limit orders due to product availability, pricing or listing errors, suspected fraud, payment authorization issues, shipping restrictions, incorrect customer information, manufacturer restrictions, quantity limitations, suspected resale or commercial purchasing, abuse of promotions, coupons, returns or customer accounts, or other legitimate business or security concerns.
If we cancel an order after payment has been captured, we will refund the applicable canceled amount to the original payment method, subject to applicable law and payment-processing timelines.
We reserve the right to limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order.
We may also limit or prohibit purchases that reasonably appear to be intended for unauthorized resale, redistribution, export, or other commercial purposes.
8. Pricing Errors and Inaccuracies
Occasionally, information on the Site may contain typographical errors, inaccuracies, omissions, incorrect prices, incorrect promotional terms, inventory errors, shipping errors, or other mistakes.
We reserve the right to correct errors and update information at any time.
If a product is mistakenly listed at an incorrect price or under incorrect promotional terms, we may cancel the affected order to the extent permitted by applicable law, including after an order has been submitted.
If payment has already been collected for a canceled item, the applicable amount will be refunded.
9. Billing and Account Information
You agree to provide current, complete, and accurate information for purchases made through Pure Supply Shop.
You represent and warrant that you are authorized to use any payment method submitted in connection with an order.
You are responsible for maintaining the confidentiality and security of your account credentials.

10. Shipping
Shipping and delivery are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference.
Pure Supply Shop offers free standard shipping on qualifying orders over $65 within the contiguous United States, subject to our Shipping & Returns Policy.
Orders placed before 9:00 AM ET, Monday through Friday, generally ship the same business day. Orders placed at or after 9:00 AM ET generally ship the following business day, excluding holidays and other exceptions stated in our Shipping & Returns Policy.
Shipping and delivery dates are estimates and are not guarantees.
Carrier delays, weather, natural disasters, incorrect addresses, customs processing, transportation disruptions and other events outside our reasonable control may affect delivery.
11. Returns and Refunds
Returns, exchanges and refunds are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference.
Eligible products may generally be returned within 30 days of delivery.
To qualify for a standard return, products must be unused, unopened and in their original packaging.
For health, hygiene and safety reasons, opened or used products are generally not eligible for return. This includes supplements, nutrition products, skincare, cosmetics, haircare, personal-care products, and other health and beauty products.
A product with a broken or removed manufacturer seal is generally considered opened.
Different procedures apply to products that arrive damaged, defective, or incorrect, as described in our Shipping & Returns Policy.
We reserve the right, to the extent permitted by applicable law, to reject returns that do not satisfy our stated return requirements or that show evidence of abuse, fraud, tampering, excessive use, or manipulation.
12. Order Cancellations
We begin processing orders promptly.
Orders may only be canceled before they enter processing or fulfillment.
Because fulfillment may begin shortly after an order is placed, we cannot guarantee cancellation of any order after submission.
Once an order has been processed or shipped, it cannot be canceled and must instead be handled in accordance with our Shipping & Returns Policy.
13. Promotions, Coupons and Discounts
Promotional offers, discount codes, coupons, gifts, loyalty incentives, and other promotions may be subject to additional terms.
Unless expressly stated otherwise, promotions cannot be combined, have no cash value, cannot be applied retroactively, may exclude certain brands or products, and may be limited by customer, account, household, address, or order.
We reserve the right to cancel orders or revoke promotional benefits where we reasonably determine that a promotion was obtained through fraud, manipulation, automated activity, multiple accounts, or other abuse.

Pure Supply Shop sells products manufactured by third parties.
Except to the extent expressly represented by Pure Supply Shop or required by applicable law, trademarks, product names, manufacturer claims, warranties and other intellectual property associated with those products belong to their respective owners.
References to third-party brands do not necessarily imply sponsorship, partnership, endorsement, or affiliation beyond Pure Supply Shop's lawful sale or marketing of the applicable products.
Manufacturer warranties, where applicable, are subject to the manufacturer's own terms.
15. Optional Tools and Third-Party Services
We may provide access to third-party tools, payment services, applications, integrations, or features.
We do not necessarily control these third-party services.
To the maximum extent permitted by applicable law, third-party tools are provided on an “as available” basis, and your use of them may also be subject to the applicable third party's terms and privacy practices.

Pure Supply Shop is not responsible for examining or evaluating third-party websites and does not warrant their accuracy, security, products, services, or practices.

17. Reviews, Comments and User Content
If you submit a review, photograph, comment, suggestion, testimonial, feedback, or other content (“User Content”), you represent that you have the right to submit that content.
You grant Pure Supply Shop a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, adapt, publish and otherwise use your User Content in connection with operating, promoting and marketing Pure Supply Shop and its Services, subject to applicable law.
You agree that User Content will not infringe another person's rights, contain unlawful or defamatory material, contain malware, misrepresent your identity or relationship to a product, or contain knowingly false or misleading information.

21. Disclaimer of Warranties

We do not guarantee that the Site will always be uninterrupted, timely, secure, or error-free.
Except for warranties expressly provided by us or rights that cannot legally be waived, we disclaim warranties and conditions of every kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.
We do not guarantee that any product will produce a particular health, cosmetic, nutritional, fitness, appearance, or wellness result. Individual results may vary.
Nothing in these Terms limits any warranty, remedy, or consumer protection that cannot lawfully be waived.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PURE SUPPLY SHOP AND ITS OWNERS, PARENTS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION OR REPLACEMENT COSTS, ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS OR THESE TERMS.
To the maximum extent permitted by applicable law, Pure Supply Shop's aggregate liability arising out of or relating to a particular product, transaction, the Services, or these Terms will not exceed the greater of:
(a) the amount you paid Pure Supply Shop for the product or transaction giving rise to the claim during the twelve months preceding the event giving rise to the claim; or
(b) $100 USD.
These limitations apply regardless of the theory of liability, including contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these limitations will apply only to the maximum extent permitted by law.
23. Product Misuse and Adverse Reactions
To the maximum extent permitted by applicable law, Pure Supply Shop is not responsible for injury, loss, or damage caused by failure to follow product directions or warnings, use contrary to manufacturer labeling, improper dosage or excessive consumption, improperly combining products, undisclosed allergies or sensitivities, improper storage after delivery, modification or tampering after delivery, use after expiration, or use for purposes not intended by the manufacturer.
Nothing in this section limits liability that cannot legally be excluded.
24. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend and hold harmless Pure Supply Shop and its parents, affiliates, owners, officers, directors, employees, agents, contractors, service providers, suppliers and licensors from third-party claims, liabilities, damages, losses, costs and reasonable attorneys' fees arising from your material breach of these Terms, unlawful use of the Services, User Content submitted by you, violation of another person's rights, fraud, willful misconduct, or violation of applicable law.
This provision does not require you to indemnify Pure Supply Shop for claims resulting solely from Pure Supply Shop's own conduct where such indemnification is prohibited by law.
25. Force Majeure
Pure Supply Shop will not be liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, epidemics, pandemics, government actions, labor disputes, transportation disruptions, carrier delays, supply shortages, utility failures, internet or telecommunications failures, cyberattacks, or failures of suppliers, manufacturers, carriers, or service providers.
26. Termination
These Terms remain effective until terminated.
You may stop using the Services at any time.
We may suspend or terminate your account or access to the Services when reasonably necessary due to a violation of these Terms, suspected fraud, abuse, unlawful activity, security risk, or other legitimate business reason.
Provisions that by their nature should survive termination will remain effective.
27. Consumer Rights and Savings Clause
Nothing in these Terms is intended to waive or limit any consumer protection, warranty, privacy, or other legal right that cannot lawfully be waived or limited by contract.
If applicable law provides you with rights that conflict with any portion of these Terms, the applicable provision will be interpreted and enforced only to the maximum extent permitted by law.
28. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
Agreement to Arbitrate
Except for disputes eligible for small claims court, requests for temporary or preliminary injunctive relief concerning intellectual property or unauthorized access to the Services, and disputes that applicable law prohibits from being arbitrated, you and Pure Supply Shop agree that disputes arising out of or relating to these Terms, the Services, or products purchased through the Services will be resolved through binding individual arbitration rather than in court.
Arbitration will be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules.
This arbitration agreement survives termination of these Terms.
Informal Dispute Resolution
Before initiating arbitration, the party asserting a claim must provide the other party with written notice describing the nature and basis of the claim and the requested relief.
Notices to Pure Supply Shop must be sent to support@puresupplyshop.com.
The parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days after receipt of the notice before initiating arbitration, unless applicable law requires otherwise.
Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND PURE SUPPLY SHOP AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING.
Unless both parties agree otherwise or applicable law requires otherwise, an arbitrator may not consolidate the claims of multiple individuals.
Arbitration Opt-Out
You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms.
Your notice must contain your name, mailing address, email address, and a clear statement that you wish to opt out of the arbitration provision contained in the Pure Supply Shop Terms of Service.

Opting out of arbitration does not affect the remaining provisions of these Terms.
Severability of Arbitration Terms
If any portion of this arbitration provision is determined to be unenforceable with respect to a particular claim or remedy, that portion will be severed to the extent permitted by law and the remaining provisions will continue in effect.
If the class-action waiver is determined to be unenforceable as to a particular claim, that claim will proceed in a court of competent jurisdiction rather than class arbitration, unless applicable law requires otherwise.
29. Governing Law
These Terms and your use of the Services will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except to the extent applicable federal law or non-waivable law of another jurisdiction applies.
Subject to the arbitration provisions above, any judicial proceeding permitted under these Terms will be brought in an appropriate state or federal court located in New Jersey, and the parties consent to jurisdiction and venue there, except where applicable law provides otherwise.
30. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.
The remaining provisions will remain in full force and effect.
31. No Waiver
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
32. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, corporate reorganization, or other business transaction, subject to applicable law.
33. Entire Agreement
These Terms, together with our Privacy Policy, Shipping & Returns Policy, and any additional policies or terms expressly incorporated by reference, constitute the entire agreement between you and Pure Supply Shop regarding your use of the Services.
They supersede prior or contemporaneous communications relating to the same subject matter.
